This Public Offer (“Offer”) sets out the general terms and conditions under which EverCars provides vehicle rental services to its customers in accordance with the applicable legislation of Ukraine.

By booking a vehicle through our website, by phone, via email, messaging applications, or by any other available communication channel, the Customer confirms that they have read, understood, and accepted the terms of this Offer.

This document governs the basic principles of cooperation between EverCars and its customers, including booking procedures, vehicle rental conditions, the rights and obligations of both parties, and other matters related to the provision of our services.

  1. Definitions

For the purposes of this Offer, the following terms shall have the meanings below:

Company – EverCars, the provider of vehicle rental services.

Customer – any individual or legal entity requesting or using the Company’s rental services.

Vehicle – a passenger car provided by the Company for temporary use under agreed rental conditions.

Booking – a reservation request for a selected vehicle for a specified date and rental period.

  1. Scope of Services

EverCars provides short-term and long-term vehicle rental services for private individuals, business customers, tourists, and corporate clients.

Information regarding available vehicles, rental rates, optional services, and other relevant details is published on the Company’s website and may be updated when necessary.

  1. Booking Procedure

Customers may request a vehicle by using one of the available communication methods:

  • submitting an online booking request;
  • contacting our team by phone;
  • sending an email inquiry;
  • using available messaging applications.

After receiving a request, our representatives contact the Customer to confirm vehicle availability, rental details, and other necessary information.

A booking becomes effective after confirmation by both parties.

  1. Vehicle Handover

The vehicle is delivered to the Customer at the agreed location and time.

Before the handover, both parties may inspect the vehicle, including:

  • exterior condition;
  • interior cleanliness;
  • available equipment and accessories;
  • fuel level;
  • required documents;
  • visible technical condition.

The transfer of the vehicle is confirmed according to the procedures agreed upon between the Company and the Customer.

  1. Customer Rights and Responsibilities

The Customer has the right to:

  • receive a roadworthy and properly prepared vehicle;
  • use the vehicle according to the agreed rental conditions;
  • receive assistance regarding the rental process when required.

The Customer agrees to:

  • operate the vehicle responsibly;
  • comply with applicable traffic regulations;
  • return the vehicle within the agreed rental period;
  • immediately inform the Company about accidents, damage, mechanical issues, or any circumstances affecting the vehicle during the rental.
  1. Company Rights and Responsibilities

EverCars reserves the right to:

  • verify compliance with the rental agreement;
  • refuse to provide a vehicle where permitted by applicable law or Company policies;
  • request proper fulfillment of the agreed rental conditions.

The Company undertakes to:

  • provide a properly maintained vehicle;
  • supply accurate information regarding rental conditions;
  • deliver professional customer support throughout the rental period.
  1. Rental Fees and Payment

Rental prices are determined according to the rates published by the Company at the time of booking.

Payment methods and payment terms are agreed upon before the vehicle is handed over.

Optional services requested by the Customer may be charged separately unless otherwise specified.

  1. Liability

Each party is responsible for fulfilling its obligations in accordance with Ukrainian legislation and the applicable rental agreement.

The Company shall not be held liable for circumstances arising from:

  • the Customer’s violation of applicable laws or rental conditions;
  • actions of third parties;
  • force majeure events;
  • situations beyond the Company’s reasonable control.
  1. Force Majeure

Neither party shall be held liable for failure or delay in performing its obligations where such failure results from circumstances beyond reasonable control.

These circumstances may include, but are not limited to, natural disasters, military actions, emergencies, governmental restrictions, interruptions in infrastructure, or other force majeure events.

  1. Personal Data Processing

The Company may collect and process the Customer’s personal information solely for purposes directly related to providing rental services, communicating with the Customer, fulfilling contractual obligations, and complying with applicable legal requirements.

Personal data is processed in accordance with the legislation of Ukraine and the Company’s Privacy Policy published on this website.

  1. Dispute Resolution

The Company and the Customer agree to make reasonable efforts to resolve any disagreements through negotiations.

If an amicable resolution cannot be reached, disputes shall be resolved in accordance with the applicable laws of Ukraine.

  1. Amendments to This Offer

EverCars reserves the right to modify, supplement, or update this Public Offer at any time.

The revised version becomes effective upon publication on the Company’s official website unless otherwise stated.

Final Provisions
